Companion AI Chatbot Rules: SB 1344 (Enacted, Effective July 1, 2025)

Senate Bill 1344 is Florida's most significant enacted AI law. It requires operators of companion AI chatbot platforms to implement user account creation and age verification before granting access. If a user is identified as a minor, operators must take specific protective actions. Operators must also protect the confidentiality of age verification information. Violations are classified as deceptive and unfair trade practices under Florida law, carrying significant enforcement risk.

Key Requirements

Comprehensive AI Regulation: H1395 (Died in Committee)

House Bill 1395 was Florida's most ambitious AI proposal, covering government AI contracts, protections for minors, restrictions on personal data use, and prohibitions on commercial use of AI-created likenesses without consent. The bill included civil penalties and private causes of action. Although it died in the Information Technology Budget & Policy Subcommittee, similar proposals are expected in future sessions.

AI Bill of Rights: S0482 (Died in Committee)

Senate Bill 0482 proposed an Artificial Intelligence Bill of Rights for Florida, addressing AI use, parental consent requirements for minors interacting with AI systems, and restrictions on government contracts with AI-related entities. The bill reflected a growing national conversation around consumer AI protections and is likely to be reintroduced.

Chatbot Interaction Standards: H0659 (Died in Committee)

House Bill 0659 would have required chatbot operators to display specified information on any platform used to access chatbots, maintain engagement protocols including age verification, and file reports with the Department of Legal Affairs. Violations would have been considered unfair or deceptive acts with civil action remedies.

Insurance AI Restrictions: S0202 (Died in Committee)

Senate Bill 0202 proposed mandatory human reviews of insurance claim denials, prohibiting AI or algorithms as the sole basis for denying claims. The Office of Insurance Regulation would have been empowered to conduct compliance examinations. This high-risk bill reflected concerns about automated decision-making in the insurance industry.
