As of April 2026, Maine LD 2082 (signed April 13, 2026) and Nevada AB 406 (enacted 2025, effective June 29, 2025) have enacted outright prohibitions on AI providing therapy or psychotherapy services without a licensed professional. Tennessee SB 1580 (effective July 1, 2026) bans AI from representing itself as a licensed mental health professional. Missouri HB 2372 passed the House in April 2026 and is pending Senate action.
Nevada AB 406, enacted in 2025 and effective June 29, 2025, prohibits any person or entity from providing, advertising, or offering mental health services through an AI system unless those services are provided by or under the direct supervision of a licensed mental health professional. It also requires AI tools used in mental health settings to disclose their AI status to clients.
Several states prohibit AI mental health apps from advertising that they provide therapy, counseling, or psychotherapy services equivalent to those of a licensed professional. Missouri HB 2368/SB 1444 and New Jersey A 5603 target deceptive marketing by AI mental health applications that imply clinical efficacy without proper credentials or oversight.
