Maine LD 2082, signed April 13, 2026, prohibits providing therapy or psychotherapy through AI unless a licensed professional provides it. Tennessee SB 1580 (effective July 1, 2026) bars advertising or representing AI as a qualified mental health professional.
Nevada AB 406 (Chapter 283, Statutes of 2025) bars AI providers from offering systems programmed to provide services that would be professional mental or behavioral health care if a person provided them, and from representing AI as qualified to provide that care. It also limits licensed providers' use of AI and bars public schools from using AI to perform the mental health functions of counselors, psychologists or social workers.
Tennessee SB 1580 makes it a consumer protection violation ($5,000 per violation) to advertise or represent AI as a qualified mental health professional. Similar bills in Missouri (HB 2368) and New Jersey (A5603, 2024-2025 session) died without passing.
